1. Service Nature & Platform Role
We Fix EU as an Intermediary Marketplace
We Fix EU OÜ operates as a technology-enabled intermediary marketplace that facilitates connections between customers and independent service providers. We Fix EU does not directly employ service providers, and service providers are independent contractors solely responsible for the quality, safety, and legality of their work. We Fix EU is not a party to the service contract between you and the provider, but acts as a platform facilitator under Estonian law and applicable EU Digital Services Act (DSA) requirements.
2. Booking & Payment Terms
Pricing, Fees & Payment Processing
All prices displayed include a 12% platform facilitation fee. Payment is authorised at booking but captured only upon job completion confirmation. We Fix EU uses PSD2-compliant payment processing; no full card details are stored on our servers. Cancellation policy: free cancellation ≥ 30 minutes before scheduled start; late cancellations may incur a fee up to 1 hour at the provider's standard rate. Emergency bookings are non-cancellable once a provider is en route.
3. Customer Obligations & Conduct
Your Responsibilities as a Customer
You agree to: (a) provide accurate property access information and describe issues truthfully; (b) ensure safe and appropriate access to the property for the provider; (c) be present or arrange access at the agreed time; (d) not engage, pay, or negotiate with providers outside the We Fix EU platform for a period of 12 months following first introduction; (e) treat providers with respect and dignity in compliance with applicable employment equality and anti-discrimination laws; (f) not submit false, misleading, or malicious reviews.
4. Liability Limitation
We Fix EU's Liability to You
We Fix EU verifies provider credentials at onboarding but cannot guarantee the outcome of any individual service. In the event of property damage caused by a verified provider, We Fix EU will facilitate the dispute resolution process and, where applicable, assist in insurance claims. We Fix EU's maximum aggregate liability to a customer for any single incident is limited to the value of the disputed booking. We Fix EU is not liable for indirect, consequential, or incidental losses. Statutory consumer rights under Estonian Law of Obligations Act and applicable EU consumer protection directives remain unaffected.
5. Data Protection & GDPR
How We Process Your Personal Data
We Fix EU OÜ is the Data Controller under GDPR (Regulation 2016/679). We collect: name, contact details, property addresses, booking history, and communication records. Legal basis: contract performance (Art. 6(1)(b)) and legitimate interests (Art. 6(1)(f)). Data is stored on EU-based servers and retained for 7 years (financial records) and 3 years (other personal data) unless you request earlier deletion. You have the right to access, rectify, erase, port, and restrict processing of your data. Contact: privacy@wefixeu.com. You may lodge a complaint with the Estonian Data Protection Inspectorate (Andmekaitse Inspektsioon) or your local supervisory authority.
6. Dispute Resolution
Complaints, Refunds & Governing Law
Disputes must be raised via the platform within 48 hours of job completion. We Fix EU will mediate between customer and provider within 3 business days. If unresolved, disputes are subject to Estonian law and the jurisdiction of Estonian courts, or the EU Online Dispute Resolution platform (ec.europa.eu/odr). As an EU consumer, you also retain rights under applicable consumer protection laws in your country of residence.

1. Provider Status & Independent Contractor Declaration
You Are an Independent Contractor, Not an Employee
By registering as a service provider on We Fix EU, you expressly acknowledge and declare that you are an independent contractor, self-employed individual, or legally registered business entity. You are solely responsible for: (a) payment of all applicable income taxes, social security contributions, and VAT in your country of operation; (b) compliance with all applicable trade licensing, professional certification, and occupational health & safety requirements; (c) maintaining valid professional liability insurance at all times (minimum coverage €100,000); (d) your own workers' compensation, health insurance, and pension obligations. We Fix EU does not withhold taxes on your behalf and does not provide employment benefits.
2. Professional Standards & Competency Declaration
Your Warranty of Competence and Qualifications
You declare under penalty of account termination that: (a) all qualifications, trade licences, certifications, and insurance documents you upload are genuine, current, and accurate; (b) you are legally authorised to perform the services you have selected in the jurisdictions where you will operate; (c) you will only accept bookings for services within your genuine professional competence; (d) you will not misrepresent your skills, experience, or qualifications to customers or to We Fix EU; (e) your business is validly registered and compliant with all applicable commercial laws. Providing false declarations constitutes grounds for immediate account termination and may be reported to relevant authorities.
3. Platform Commission & Payment Terms
Revenue Share, Payouts & Fee Structure
You agree that We Fix EU shall deduct a platform commission of 12% from the gross value of each completed booking. Your net payout (88% of gross) will be transferred to your registered bank account every Monday for jobs completed in the preceding 7 days. We Fix EU reserves the right to withhold payout in cases of: active disputes, suspected fraud, platform policy violations, or at the direction of law enforcement. You acknowledge that the commission rate may be revised with 30 days' written notice. VAT, where applicable, is your responsibility to account for and remit to the relevant tax authority.
4. Code of Professional Conduct
Standards of Behaviour Toward Customers
You commit to: (a) arriving at the agreed time or providing advance notice of delay; (b) completing work to a professional standard consistent with applicable building, electrical, plumbing, and safety codes; (c) treating customers, their property, and all persons on site with dignity and respect; (d) not soliciting customers to conduct transactions outside the We Fix EU platform; (e) not requesting, accepting, or offering bribes, kickbacks, or undisclosed commissions; (f) maintaining confidentiality of customer data and property information; (g) reporting any suspected safety hazards beyond the scope of booked work to the customer and, where legally required, to relevant authorities. Violation of the Code of Conduct may result in immediate suspension, removal from the platform, and potential legal action.
5. Anti-Circumvention & Exclusivity
Platform Integrity & Non-Solicitation
For a period of 24 months from the date of first introduction via We Fix EU, you agree not to directly solicit, contract with, or accept payment from any customer introduced to you through the platform outside of the We Fix EU booking system. Breach of this clause entitles We Fix EU to claim liquidated damages equivalent to the platform commission that would have been earned on estimated circumvented transactions.
6. Data Processing & Provider GDPR
Processing of Provider & Customer Data
You authorise We Fix EU to process your personal and business data for platform operations, verification, matching, payment processing, and legal compliance purposes. You acknowledge that limited personal data (name, trade, rating, photo) will be displayed to customers as part of your public profile. You agree to handle customer personal data (names, addresses, contact details) solely for the purpose of fulfilling booked services, in accordance with GDPR and applicable data protection laws, and not to retain or use customer data beyond what is necessary for service delivery.
7. Insurance & Liability
Your Liability to Customers & Third Parties
You are solely liable for any damage, injury, or loss caused by your work or negligence to customers, third parties, or property. You must maintain a minimum of €100,000 professional liability insurance at all times and provide updated certificates annually. In the event of a claim, We Fix EU may facilitate communications between you and the customer but bears no liability for the outcome of your work. We Fix EU's facilitation of a dispute does not constitute admission of liability on the part of either party.
8. Account Suspension & Termination
Grounds for Suspension, Removal & Appeal
We Fix EU may suspend or terminate your provider account with immediate effect in cases of: expired or invalid documentation, rating below 3.5 stars sustained for 30+ days, completion rate below 70%, confirmed Code of Conduct violations, criminal convictions relevant to the services offered, fraudulent reviews or misrepresentation, or at the direction of law enforcement. You have the right to appeal suspension by contacting providers@wefixeu.com within 7 days. Termination without cause requires 14 days' written notice from We Fix EU.
